Terms of Service

1. Acceptance of Terms

By accessing or using Loads Africa, including the customer platform, vendor platform, website, and related services, you agree to these Terms of Service. If you do not agree, you must not use the services.

2. About Loads Africa

Loads Africa is a digital logistics marketplace operated by Loadnow Private Limited. The platform helps customers post transport requirements and enables transport companies to discover, bid for, and manage logistics opportunities.

3. Accounts and Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for protecting your login details and for activity performed through your account.

4. Customer Responsibilities

Customers must provide accurate load descriptions, pickup and delivery information, cargo specifications, timing, and any special handling requirements. Customers must not post unlawful, dangerous, misleading, or prohibited cargo.

5. Vendor Responsibilities

Transport companies must maintain valid registrations, licences, insurance, permits, vehicle records, driver records, and any other documents required by law. Vendors are responsible for safely and lawfully completing accepted transport work.

6. Marketplace Role

Loads Africa provides technology that connects marketplace participants. Unless expressly agreed otherwise in writing, Loads Africa is not the carrier, owner of transported goods, employer of drivers, or direct party to the transport contract between a customer and a vendor.

7. Bids, Pricing, and Payments

Prices and bids submitted through the platform must be clear and accurate. Applicable fees, commissions, taxes, and payment arrangements may be shown during a transaction or agreed separately. Users remain responsible for taxes and statutory charges applicable to them.

8. Tracking and Operational Data

Where tracking is enabled, users agree that location, shipment, vehicle, and delivery data may be collected and displayed for operational, safety, compliance, and service purposes.

9. Prohibited Conduct

You must not misuse the platform, interfere with its operation, submit false information, impersonate another person, bypass security controls, introduce malicious software, scrape protected information, or use the service for unlawful activity.

10. Suspension and Termination

We may restrict, suspend, or terminate access where we reasonably believe a user has violated these terms, created a safety or legal risk, failed verification, engaged in fraud, or misused the platform.

11. Disclaimers

The service is provided on an “as available” basis. While we aim to provide reliable information and verified participants, we do not guarantee uninterrupted access, successful matching, delivery outcomes, user conduct, or the accuracy of every third-party submission.

12. Limitation of Liability

To the maximum extent permitted by law, Loads Africa and Loadnow Private Limited will not be liable for indirect, incidental, special, or consequential losses arising from use of the platform, marketplace transactions, delays, cargo loss, user conduct, or third-party services.

13. Indemnity

You agree to indemnify Loads Africa and Loadnow Private Limited against claims, losses, penalties, and expenses arising from your breach of these terms, misuse of the service, violation of law, or infringement of another party's rights.

14. Changes to the Service or Terms

We may update the platform and these terms from time to time. Continued use after changes are published means you accept the revised terms.

15. Governing Law

These terms are governed by the laws of Zimbabwe, unless another law must apply under mandatory legal rules. Disputes should first be raised with our team in good faith before formal proceedings are started.
